What Happens When a Drunk Driver Hits Your Car?

In New York, no-fault insurance covers drunk driving accidents. This means that, if you are hit by a drunk driver, you can file a personal injury protection (PIP) claim with your own auto insurance provider and receive monetary compensation for covered losses.

In New York, no-fault insurance covers the following:

The social host law is narrower than the already-narrow dram shop law; you can only sue an individual host who provided alcohol to an underage guest who went on to cause injury. If a social host provides alcohol to someone over the age of 20 who is already visibly intoxicated, the social host is not legally responsible for any injuries the intoxicated individual causes.
